We built NexGen Virtual Workplace to help people connect and collaborate, not to exploit their data. We are committed to processing your data securely, transparently, and only for the purposes for which it was collected. Whether you are a visitor to our website, a user of our virtual workplace platform, or an attendee at one of our events, safeguarding your information is a core part of our mission.

2. What this Statement Covers

This Privacy Statement describes how we collect, use, and disclose information when you interact with our websites, products, and services. It applies to all users of NexGen services globally.

Data Controller Practices

When you use our services as an individual user (for example, signing up for a personal account), NexGen acts as the Data Controller for your personal information. When you use our services as part of an enterprise or educational subscription managed by an organization (e.g., your employer or school), that organization is the Data Controller, and NexGen acts as the Data Processor. In such cases, your data is subject to the organization's privacy policies and control.

Account Holder Information

We collect information necessary to provide you with your account, such as your name, email address, password, and payment information. We use this information to authenticate you, bill you for services, and communicate with you about your account status.

3. NexGen and Children

NexGen recognizes the importance of protecting the privacy and safety of children. Our services for schools and educational institutions are designed with strict privacy controls.

School Subscriber

An educational institution or district that purchases NexGen services for use by its staff and students.

K-12 Account Administrator

A designated individual within the School Subscriber organization authorized to manage accounts and permissions.

K-12 Account User

Teachers, staff, or faculty members who use the platform to facilitate education.

Student User

A student under the age of 18 (or under the age of majority in their jurisdiction) using the services under the supervision of a School Subscriber.

Children Under 16 & Student Users

NexGen does not knowingly collect personal data from children under the age of 16 without proper authorization from a School Subscriber. For Student Users, we only collect personal data reasonably necessary to provide the educational service. We do not use Student User data for marketing or advertising purposes. If we learn that we have collected personal data from a child under 16 without appropriate consent, we will delete that information as quickly as possible.

4. NexGen App Marketplace & Other Sites

Our services may include links to third-party websites, plug-ins, and applications, including those available in the NexGen App Marketplace. Clicking on those links or enabling those connections may allow third parties to collect or share data about you.

We do not control these third-party websites or applications and are not responsible for their privacy statements. When you leave our website or install a third-party application, we encourage you to read the privacy policy of every website or application you visit or use. The availability of an app in our Marketplace does not imply our endorsement of the third party's data handling practices.

Note: "Legitimate Interests" means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. 6. Customer Content

Customer Content consists of the information, files, chat logs, and transcripts that you or your users provide to NexGen through the use of the service.

We use Customer Content only in connection with providing our services to you, such as processing your files to display them in your virtual workplace or transmitting your chat messages. We do not monitor, sell, or use Customer Content for any other purposes, except as required by law or as necessary to ensure the security and integrity of our services.

Important Disclaimer: While we implement robust security measures to protect your content, you are responsible for maintaining the security of your account credentials. Unauthorized access resulting from compromised user credentials is the responsibility of the account holder.

7. NexGen's Product and Marketing Pages

We operate two distinct types of web pages, handled differently regarding privacy:

  • Product PagesThese pages require you to log in and are used to deliver our service. We use minimal cookies here, strictly necessary for authentication, security, and session management. We do not use third-party advertising trackers on our product pages.
  • Marketing PagesThese are public-facing pages (like our homepage and blog) designed to inform you about our services. Here, we may use interest-based advertising cookies and pixels to show you relevant ads on other sites. You can manage your cookie preferences or opt-out of these trackers via our Cookie Consent banner or your browser settings.

We value your privacy regarding mobile communication. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
